Ministry of Home Affairs (MHA) specifies rights of Overseas Citizen of India (OCI) Cardholders

Ministry of Home Affairs (MHA), vide notification no. S.O. 1050(E), dated 4th March 2021 specifies the rights of the Overseas Citizens of India (OCI) cardholders. This notification has an overriding effect on the erstwhile notifications issued by the Government of India in this regard.

Following rights have been given to OCI cardholders w.e.f. 4th March 2021:

  • Grant of multiple entry lifelong visa for visiting India for any purpose, however, for certain specified purposes, a special permit would be required from prescribed authority.
  • Further, the notification lists down matters in which OCI cardholders would be treated at parity with Non-Resident Indians (‘NRI’) such as purchase or sale of immovable properties other than agricultural land or farm house or plantation property.
  • Lastly, the aforesaid notification states that in respect of all other matters, not specified in this notification or under Foreign Exchange Management Act, 1999, the OCI cardholders will have same rights and privileges as a foreigner instead of NRIs.
